1. Purpose of This Policy
This Influencer Commission & Payout Policy (“Policy”) governs how influencers (including dropshippers acting as influencers) earn commissions, how commissions are calculated, when payouts are made, and the circumstances under which commissions may be withheld, reversed, or forfeited on the PopKup platform. This policy is designed to ensure transparency, fairness, and protection for all parties involved: PopKup, brand owners, influencers, and buyers.
2. Scope and Applicability
This policy applies to:
- a. All registered influencers on PopKup
- b. Dropshippers operating as a subset of influencers
- c. Brand owners who create campaigns with influencer commissions
- d. All transactions are completed through PopKup’s platform.
Participation in PopKup campaigns constitutes acceptance of this policy.
3. Influencer Eligibility
To earn commissions on PopKup, an influencer must:
PopKup reserves the right to suspend or revoke eligibility at any time for policy violations.
4. Commission Structure
4.1 Commission Determination
- a. Commission rates are set per campaign by brand owners, subject to PopKup’s platform rules.
- b. Commission percentages or fixed amounts may vary between campaigns.
- c. Influencers will see the applicable commission rate before joining a campaign.
4.2 Commission Calculation
Commissions are calculated based on:
- a. The net sale value of the product (excluding delivery fees, taxes, and platform fees unless otherwise stated)
- b. Successful completion of the transaction
- c. Confirmation of delivery and expiration of the refund window
5. Temporary Escrow & Commission Hold
- a. All payments, including influencer commissions, are held in temporary escrow by PopKup.
- b. Commissions are not immediately available upon sale.
- c. Funds remain on hold until:
- i. Delivery is confirmed.
- ii. The platform’s 7-day refund window has elapsed.
- iii. No active dispute exists on the transaction
This structure protects all parties from fraud, failed deliveries, or unresolved disputes.
6. Payout Eligibility
An influencer becomes eligible for payout when:
- a. The associated transaction is marked as completed
- b. The refund window has closed without reversal
- c. There is no unresolved dispute, investigation, or policy breach
- d. The influencer’s account remains in good standing.
PopKup reserves the right to delay payouts where verification or investigation is required.
7. Payout Schedule and Method
- a. Payouts are processed periodically based on PopKup’s internal payout cycles.
- b. Payout frequency, supported payout methods, and minimum payout thresholds will be communicated within the platform.
- c. Influencers are responsible for providing accurate and up-to-date payout information. PopKup is not responsible for delays caused by incorrect payment details or third-party payment processors.
8. Commission Reversal and Forfeiture
Commissions may be reversed, withheld, or forfeited under the following circumstances:
- a. Buyer refunds approved under PopKup’s Refund Policy
- b. Failed, incomplete, or canceled transactions
- c. Proven influencer misconduct or policy violations
- d. Fraudulent activity, including fake orders or manipulation
Misrepresentation of products or deceptive marketing practices where a commission has already been paid out: PopKup reserves the right to deduct the reversed amount from future earnings.
9. Influencer Conduct and Responsibilities
Influencers must:
- a. Promote products truthfully and responsibly.
- b. Avoid exaggerated, false, or unverifiable claims
- c. Clearly disclose promotional intent where required by applicable laws
- d. Respect PopKup’s brand, community standards, and campaign rules.
Non-compliance may result in warnings, suspension, termination, or loss of earnings.
10. Disputes Related to Commissions
- a. Commission-related disputes are handled under PopKup’s Dispute Resolution Policy.
- b. Influencers may submit an appeal within 7 days of a commission-related decision.
- c. Decisions after appeal are final within the platform.
11. Taxes and Legal Compliance
- a. Influencers are solely responsible for declaring and paying any applicable taxes on earnings.
- b. PopKup does not provide tax, legal, or financial advice.
- c. Influencers must comply with local laws and regulations applicable in their country of operation.
12. Policy Enforcement
PopKup may enforce this policy through:
- a. Account warnings
- b. Temporary suspension of payouts
- c. Campaign restrictions
- d. Permanent account termination
Enforcement actions are taken at PopKup’s sole discretion and in alignment with other platform policies.
13. Modifications to This Policy
PopKup reserves the right to amend this policy at any time. Updates will be communicated through the platform, and continued use constitutes acceptance of the revised terms.
