Acceptable Use Policy (AUP)

This Acceptable Use Policy (“AUP”) governs access to and use of the PopKup platform (the “Platform”), operated by PopKup (“PopKup,” “we,” “us,” or “our”). The platform connects brand owners (sellers) and influencers (affiliate marketers) to promote and sell products through influencer-led storefronts and campaigns.

By accessing or using the Platform, you agree to comply with this AUP, our Terms of Service, Privacy Policy, and all applicable laws and regulations. Failure to comply may result in suspension or termination of your account, removal of content, withholding of payouts, and/or legal action.

1. Scope and Applicability

This AUP applies to:

  • a. All users of the Platform, including brandOwners, influencers, Dropshippers, visitors, and any other persons accessing PopKup services.
  • b. All content, products, campaigns, storefronts, communications, integrations, and transactions conducted on or through the Platform.

2. User Eligibility and Account Responsibilities

2.1 Account Integrity

Users agree to:

  • a. Provide accurate, complete, and up-to-date registration information.
  • b. Maintain the confidentiality of login credentials.
  • c. Be fully responsible for all activities conducted under their account.
  • d. Promptly notify PopKup of any unauthorized access or security breach.
  • e. Impersonation, creation of fake accounts, or use of another person’s identity is strictly prohibited.

3. Permitted Use of the Platform

Users may use the platform solely for lawful purposes, including:

  • a. Creating and managing storefronts.
  • b. Listing and promoting legitimate products.
  • c. Participating in influencer campaigns in compliance with platform rules.
  • d. Engaging in lawful marketing, advertising, and affiliate activities.

All use must align with PopKup’s intended purpose as an influencer-based e-commerce marketplace.

4. Prohibited Activities

The following activities are strictly prohibited:

4.1 Illegal and Harmful Activities

  • a. Selling, promoting, or facilitating illegal goods or services.
  • b. Activities involving fraud, theft, money laundering, or financial crime.
  • c. Use of the platform to exploit, abuse, or harm any individual or group.

4.2 Misrepresentation and Deceptive Practices

  • a. False or misleading product descriptions, pricing, or claims.
  • b. Misrepresentation of product origin, quality, availability, or certifications.
  • c. Artificial inflation of sales, clicks, engagement, or reviews.

4.3 Platform Abuse

  • a. Circumventing platform safeguards, payment systems, or commission structures.
  • b. Scraping, harvesting, or extracting data without authorization.
  • c. Reverse engineering, disrupting, or overloading the platform’s infrastructure.

4.4 Intellectual Property Violations

  • a. Uploading or selling counterfeit goods.
  • b. Infringing copyrights, trademarks, patents, or trade secrets.
  • c. Using PopKup branding without written authorization.

4.5 Inappropriate or Harmful Content

  • a. Content that is defamatory, obscene, pornographic, hateful, or discriminatory.
  • b. Content promoting violence, extremism, or harassment.
  • c. Content that violates advertising standards or consumer protection laws.

5. Product and Listing Standards (Brand Owners)

Brand owners must ensure that:

  • a. All listed products are genuine, safe, and compliant with applicable laws in all jurisdictions where the products are marketed or sold.
  • b. Products meet quality, labeling, consumer protection, and safety standards.
  • c. Pricing, discounts, availability, and campaign terms are transparent, accurate, and not misleading.
  • d. Products do not fall within categories that PopKup may restrict or prohibit from time to time based on legal, regulatory, or platform risk considerations.
  • e. PopKup reserves the right to review, remove, suspend, or restrict any product listing at its discretion where compliance, safety, or trust concerns arise.
  • f. Pricing, discounts, and campaign terms are transparent and accurate.
  • g. Products do not fall under PopKup’s Restricted or Prohibited Items List (as may be updated from time to time).
  • h. PopKup reserves the right to remove or suspend any product listing that violates these standards.

6. Influencer and Affiliate Conduct

Influencers (including dropshippers, who are treated as a subset of influencers) must:

  • a. Promote products honestly, responsibly, and in good faith.
  • b. Use language and representations that are accurate and aligned with the information provided by brand owners.
  • c. Avoid exaggerated, deceptive, or unverifiable claims about products.
  • d. Clearly disclose promotional or affiliate relationships where required by applicable advertising and consumer protection standards.
  • e. Refrain from spam, misleading traffic generation, or manipulative marketing tactics.

Any attempt to manipulate campaigns, commissions, tracking systems, or audience behavior through deceptive means is strictly prohibited.

7. Payments, Payouts, and Financial Conduct

Users must not:

  • a. Engage in chargeback abuse or payment manipulation.
  • b. Attempt to bypass PopKup’s payment and payout systems.
  • c. Use stolen or unauthorized payment methods.
  • d. PopKup reserves the right to delay, suspend, or withhold payouts where fraud, abuse, or policy violations are suspected.

8. Data Protection and Privacy

  • a. Handle personal data obtained through the Platform lawfully and securely.
  • b. Use customer data only for authorized transaction-related purposes.
  • c. Comply with applicable data protection and privacy laws.
  • d. Unauthorized sharing, selling, or misuse of personal data is strictly prohibited.

9. Monitoring, Enforcement, and Remedies

PopKup reserves the right to monitor activity, content, and transactions on the Platform and to investigate suspected violations of this AUP.

Enforcement actions may follow a graduated approach, including:

  • a. Formal warnings or notices of violation.
  • b. Temporary suspension of accounts, campaigns, listings, or payouts.
  • c. Permanent account termination.
  • d. Removal of content or product listings.
  • e. Forfeiture or withholding of earnings associated with policy violations.
  • f. Reporting to law enforcement or regulatory authorities where required.

The type and severity of enforcement applied will depend on the nature, frequency, and impact of the violation. Still, PopKup retains the right to take immediate action in cases involving fraud, illegal activity, or significant risk to users or the Platform.

10. Reporting Violations

Users may report suspected violations of this AUP by contacting: support@popkup.com. Reports should include sufficient detail to allow investigation.

11. Updates and Modifications

PopKup may update this AUP from time to time. Continued use of the Platform after changes become effective constitutes acceptance of the revised policy.

12. Governing Law and Jurisdiction

This AUP shall be governed by and construed in accordance with the laws of the jurisdiction in which PopKup is incorporated, without regard to conflict of law principles. Where PopKup operates in multiple countries, users agree that PopKup may apply local laws, regulations, and compliance standards as required in each operating region.
